Breach of Duties to UK Pension Fund Participants

The London High Court of Justice Chancery Division ruled that IBM breached its contractual duties to UK pension fund participants in the way it implemented a restructuring of its arrangements in 2009. The court found that the way in which IBM announced, consulted, and implemented the changes (in a process called “Project Waltz”) was in breach of its duty of good faith to its employees, and that IBM also breached its implied contractual duty of trust and confidence of its employees.
