U.S. ex rel. DiMattia et al. v. Medco Health Solutions (AstraZeneca Kickback Scheme)

Medco Health Solutions, a wholly-owned subsidiary of Express Scripts Holding Company, paid $7.9 million to settle allegations that it engaged in a kickback scheme in violation of the False Claims Act. The settlement resolved allegations that Medco solicited remuneration from pharmaceutical company AstraZeneca in exchange for identifying Nexium as the “sole and exclusive” proton pump inhibitor on Medco’s prescription drug lists. Medco allegedly received some or all of the remuneration in the form of reduced prices on AstraZeneca drugs Prilosec, Toprol XL, and Plendil, in violation of the Federal Anti-Kickback statute, and submitted false or fraudulent claims for Nexium to the Retiree Drug Subsidy Program.
