Cunningham et al. v. FedEx (Violation of USERRA)

A proposed class action lawsuit claims thousands of current and former FedEx employees did not receive the full pension and retirement contributions mandated by the Uniformed Services Employment and Reemployment Rights Act (USERRA) for the periods in which they took leave to serve in the United States Armed Forces. The lawsuit alleges that since 2002 FedEx and the pension plan defendants have used a formula for determining pension and retirement contributions for periods of qualified military service that did not comply with the requirements of USERRA.
